Terms of Service

1. Agreement to Terms

By accessing or using LeadPortal (leadportalapp.com), you agree to be bound by these Terms of Service. If you do not agree, do not use our services. These terms apply to all users including homeowners receiving lead routing and HVAC contractors using the platform. LeadPortal is operated by Temperature Tom LLC.

2. Service Description

LeadPortal is an HVAC lead generation platform serving licensed, local HVAC contractors nationwide. We match pre-qualified homeowner leads with one contractor per service area. The service is free for homeowners.

3. Contractor Terms

  • Each lead is exclusive — delivered to one contractor only and may not be resold or shared.
  • You must contact all delivered leads within 24 hours.
  • Disputes must be submitted within 48 hours of lead delivery via the contractor portal.
  • Approved disputes may result in lead replacement credits at our sole discretion.
  • We reserve the right to pause or terminate accounts for abuse, fraudulent chargebacks, or violation of these terms.
  • You are responsible for maintaining valid licenses and insurance as required by applicable state and local law.

4. Logo & Marketing Use (Contractors)

By creating a contractor account on LeadPortal (including through any sign-up, application, onboarding, or lead-submission form on leadportalapp.com or any affiliated landing page), you grant LeadPortal and Temperature Tom LLC a non-exclusive, royalty-free, worldwide, revocable-on-request license to use, display, and reproduce your business name, logo, trade name, trademarks, service marks, and any brand marks you submit to us or that are publicly associated with your business.

This license covers use on our website (including any landing page, "people we've worked with", "trusted by", "partners", or similar social-proof section), in marketing and advertising materials, on social media, in investor and partner decks, and in press and PR. You represent that you have the authority to grant this license for the marks you provide or display publicly.

We will use your marks only in accurate, non-disparaging contexts — as an identification of a contractor who has signed up for or worked with LeadPortal — and will not use them in a way that falsely suggests an endorsement or partnership beyond the actual relationship.

Opt-out: You may withdraw this license at any time by emailing tom@leadportalapp.com with the subject line "Logo Opt-Out." We will remove your marks from our owned web properties within 14 days and from other active marketing channels on their next reasonable refresh cycle. Opting out of logo use does not affect any other rights or obligations under these Terms.

5. Homeowner Terms

  • The service is completely free for homeowners.
  • By submitting a lead request, you consent to being contacted by HVAC contractors via phone, text, or email.
  • We match you with one local contractor. You have no obligation to hire them.
  • Contractor quality is not guaranteed. We vet contractors but are not liable for their work.

6. Payments, Cancellation, Refunds, and Territory Release

Payment processing. Payments are processed via Stripe. By providing payment information, you authorize us to charge your payment method per the terms agreed at signup, onboarding, or at leadportalapp.com/start. LeadPortal billing cadence depends on which product you purchased: (a) self-serve signups at leadportalapp.com/start are billed weekly for 4 weeks and hard-end after the 4th charge with no auto-renewal; (b) custom plans negotiated by phone are billed on the cadence agreed in that call (typically weekly with auto-renew or a capped number of weekly cycles).

No refunds. All charges are non-refundable once a billing cycle starts. LeadPortal does not issue partial-week refunds, partial-month refunds, pro-rated credits, or cash refunds for unused leads. Disputed individual leads may be reviewed on a case-by-case basis and, at our discretion, may result in replacement lead credits (never cash).

Cancellation. You may cancel the remaining scheduled charges at any time from your contractor portal billing page or by emailing tom@leadportalapp.com. Cancellation stops future billing and stops future lead delivery. The current billing cycle runs its full term and is not refunded. On the final day of the current cycle — or on the natural end of the 4-payment run for self-serve plans — your exclusive territory (ZIP) is released back to the LeadPortal pool and becomes available to another contractor. There is no continuing right or reservation to a ZIP once released.

Payment failure. If a scheduled charge fails for any reason (expired card, insufficient funds, bank decline, etc.), lead delivery is paused immediately. You have seven (7) calendar days from the failed charge to update your payment method and bring the account current. If the account is not current at the end of that grace period, your territory is released back to the pool and your account is moved to a cancelled state. For self-serve 4-week runs, a failed charge in the middle of the run does not extend the run — the subscription still hard-ends at payment 4 (or earlier if the account is released).

Chargebacks. Disputing a completed, paid charge through your card issuer ("chargeback") is a breach of these Terms. A chargeback will: (a) immediately close your account, (b) forfeit any pending First-Close Guarantee claim, (c) release your territory back to the pool, and (d) cause any signed minimum-commitment balance (if applicable) to become immediately due and collectible. If you believe a charge was made in error, please email us directly at tom@leadportalapp.com before opening a dispute — most errors can be resolved inside a business day.

Territory exclusivity. A ZIP code is considered "reserved" for you only while your subscription is active and paid in good standing. An active subscription in one ZIP does not reserve any adjacent or additional ZIP. Once released (by cancellation, non-payment past grace, or chargeback), you have no continuing right or reservation to that ZIP; a returning contractor must re-subscribe and re-check availability at leadportalapp.com/start.

First-Close Guarantee. The LeadPortal First-Close Guarantee is subject to reporting gates including a two-hour initial response SLA, three contact attempts per lead, 24-hour outcome logging, and keeping ads and your calendar live for the full first paid week. Guarantee is leads-only (never cash), offered once per business lifetime, and is forfeited on chargeback, cancellation during the qualifying week, or removal of payment method. 7. SMS Terms & Conditions

Program Name: LeadPortal Service Alerts

Program Description: LeadPortal sends transactional SMS messages to homeowners and HVAC contractors. Homeowners receive service request confirmations, follow-up messages, job completion checks, and review requests. Contractors receive lead assignment notifications, call reminders, onboarding messages, and account alerts.

Message Frequency: Message frequency varies. Homeowners typically receive 1–5 messages per service request. Contractors typically receive 1–10 messages per week depending on lead volume and account activity.

Message & Data Rates: Standard message and data rates may apply depending on your mobile carrier and plan. LeadPortal does not charge for SMS messages.

Opt-Out: You can opt out of SMS messages at any time by replying STOP to any message. After opting out, you will receive a single confirmation message and no further SMS messages will be sent.

Carriers are not liable for delayed or undelivered messages. By opting in to SMS, you agree to these SMS terms.

8. CAN-SPAM Compliance

All commercial email communications from LeadPortal comply with the CAN-SPAM Act. Each email includes our physical address, a clear subject line, and an unsubscribe mechanism. To unsubscribe from marketing emails, reply to any email with "unsubscribe" or email tom@leadportalapp.com. Transactional emails (lead delivery, account confirmations) cannot be opted out of while maintaining an active account.

9. Limitation of Liability

LeadPortal is not liable for: the quality of work performed by any contractor; any damages arising from a contractor-homeowner relationship; loss of profits or business; or any indirect, incidental, or consequential damages. Our total liability is limited to the amount paid by the party making the claim in the 30 days prior to the dispute.

10. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of the State of New Jersey.

11. Changes to Terms

We may update these Terms at any time. Continued use of our service after changes constitutes acceptance of the new Terms. We will notify active contractors of material changes via email.

12. Stripe Connect & Contractor Payouts

Contractors who enable the LeadPortal invoicing feature do so via Stripe Connect. By connecting a Stripe account you additionally agree to the Stripe Connected Account Agreement and the Stripe Services Agreement, which govern homeowner payments, payouts to your bank account, refunds, and disputes initiated by homeowners.

Homeowner payments made through a LeadPortal invoice are processed by Stripe as a destination charge to your connected account. Payouts to your bank occur on Stripe's standard payout schedule. LeadPortal is not a party to the homeowner-contractor service contract and is not responsible for the quality, completion, or warranty of the work performed.
